Superior A.R.T. BD. TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By accessing and using the Superior A.R.T. Bangladesh website (hereinafter referred to as “Website”) and/or scheduling an appointment for fertility treatments, you agree to be bound by these Terms and Conditions. If you do not agree to abide by these terms, please do not use our services. Superior A.R.T. Bangladesh reserves the right to modify these terms at any time, and the modified terms shall become effective upon posting on the Website.

2. SERVICES PROVIDED

Superior A.R.T. Bangladesh is a fertility and assisted reproductive technology (ART) center located in Dhaka, Bangladesh, with medical oversight from our parent organization Superior A.R.T. in Thailand. Our services include, but are not limited to:

  • In Vitro Fertilization (IVF) and Intracytoplasmic Sperm Injection (ICSI)
  • Intrauterine Insemination (IUI)
  • Embryo Freezing and Cryopreservation
  • Semen Analysis and Fertility Testing
  • Infertility Evaluation and Consultation
  • Fertility Counseling and Support Services

3. PATIENT ELIGIBILITY AND REQUIREMENTS

  • 3.1 Age and Legal Capacity: Patients must be at least 18 years of age and possess the legal capacity to enter into binding agreements. All treatment decisions must be made voluntarily and without duress.
  • 3.2 Medical Fitness: Patients must undergo a complete medical evaluation to determine their suitability for fertility treatments. Some medical conditions may contraindicate certain procedures. The clinic reserves the right to decline treatment if the patient's health condition poses significant risk.
  • 3.3 Marital Status: In accordance with Bangladesh law and clinic policy, fertility treatments are provided only to legally married couples. Patients must provide valid marriage documentation upon request.

4. FINANCIAL TERMS

  • 4.1 Pricing and Packages: All service packages and their prices are clearly displayed on our Website and communicated during initial consultations. Pricing is subject to change without notice, though registered patients will be notified of price changes.
  • 4.2 Payment Terms: Payment is due as specified in the treatment package agreement. Payment methods accepted include bank transfer, credit card, and cash. An initial deposit/down payment may be required to confirm appointment and begin treatment procedures.
  • 4.3 Payment Plans: For applicable packages, patients may opt for installment payment plans. The terms of installment plans, including due dates and consequences of late payment, will be clearly communicated in writing
  • 4.4 Refund Policy: Refunds are provided based on the following conditions:
  • If the patient cancels treatment before commencement of the stimulation cycle, 50% of payments received may be refunded (non-refundable amount covers consultation, diagnosis, and administrative costs).
  • Once the stimulation cycle has commenced, no refunds shall be provided, as medications and procedures have been administered or arranged.
  • If the clinic cancels a scheduled procedure due to medical contraindications, a full refund for that specific procedure shall be offered.
  • Patients with unsuccessful treatment cycles are not entitled to automatic refunds; however, unutilized services included in the package may be credited toward future treatment cycles.
  • Embryo freezing and storage charges are non-refundable unless the clinic fails to provide the agreed-upon services.

 4.5 Late Payment Charges: If payment is not received by the agreed-upon date, a late payment charge of 2-5% per month may be levied on the outstanding amount, as per clinic policy.

5. MEDICAL CONFIDENTIALITY AND PRIVACY

  • 5.1 Patient Privacy: Superior A.R.T. Bangladesh is committed to maintaining the highest standards of patient confidentiality in accordance with Bangladesh Medical and Dental Council guidelines and international medical ethics standards
  • 5.2 Data Protection: All patient medical records, genetic test results, and personal information are stored securely and will not be shared with third parties without explicit written consent, except as required by law.
  • 5.3 Medical Records Access: Patients have the right to access their own medical records upon written request. Records will be provided within 7-10 business days.
  • 5.4 Research and Publication: Any use of de-identified patient data or cases for research or educational purposes will require prior written consent from the patient.

6. INFORMED CONSENT AND TREATMENT PROCEDURES

  • 6.1 Informed Consent: Before commencing any treatment, patients must sign comprehensive informed consent forms detailing:
  • The nature, purpose, and procedure of the treatment
  • Potential risks, complications, and side effects
  • Success rates and realistic expectations
  • Alternative treatment options
  • Use of medications and their potential effects
  • 6.2 Medical Records and Tests: Patients grant permission for the clinic to conduct all necessary medical tests, diagnostic procedures, and keep detailed medical records. These records are the property of the clinic but accessible to the patient.
  • 6.3 Genetic Testing Consent: For patients opting for PGT (Preimplantation Genetic Testing), explicit written consent is required for embryo biopsy and genetic analysis. Consent regarding the handling and storage of genetic information is also mandatory.

7. MEDICAL RISKS AND DISCLAIMERS

  • 7.1 No Guarantee of Success: Fertility treatments, including IVF, are not guaranteed to result in pregnancy or live birth. Success rates depend on multiple factors including age, ovarian reserve, sperm quality, and embryo quality. Patients acknowledge that even with best medical care, pregnancy may not occur.
  • 7.2 Known Risks: Patients acknowledge awareness of the following potential risks:
  • Ovarian Hyperstimulation Syndrome (OHSS): Mild to severe, requiring hospitalization in rare cases
  • Bleeding, infection, or perforation during egg retrieval
  • Medication side effects including headaches, nausea, mood changes
  • Multiple gestation (twins, triplets, etc.)
  • Ectopic pregnancy
  • Miscarriage
  • Rare but serious complications including blood clots, organ damage
  • 7.3 Assumption of Risk: By signing the informed consent, patients voluntarily assume all risks associated with their chosen treatment and absolve Superior A.R.T. Bangladesh of responsibility for natural complications arising during standard medical procedures, unless caused by gross negligence or misconduct.

8. EMBRYO AND GAMETE STORAGE TERMS

  •  8.1 Cryopreservation Services: The clinic provides cryopreservation (freezing) services for embryos, eggs, and sperm. Standard storage period is one year from the date of freezing. Extended storage requires annual renewal payment.
  • 8.2 Storage Renewal: Upon expiration of the storage period, patients will be notified. If renewal fees are not paid within 30 days of notification, the clinic reserves the right to dispose of stored embryos/gametes in accordance with regulatory guidelines.
  • 8.3 Ownership and Disposition: Patients retain full ownership of their stored biological materials. Upon patient request, materials may be:
  • Used for patient's own treatment
  • Transported to another clinic (if patient requests transfer)
  • Donated to research (with explicit written consent)
  • Destroyed (with written instructions)
  • 8.4 Contingency Plan: Patients must provide written instructions regarding the fate of stored materials in case of death, divorce, or loss of contact. Without such instructions, the clinic will follow Bangladesh legal guidelines for disposal.

9. APPOINTMENT AND CANCELLATION POLICY

  • 9.1 Booking Appointments: Appointments must be scheduled at least 7-14 days in advance, or as specified by the clinic. A deposit or advance payment may be required to secure the appointment.
  • 9.2 Cancellation by Patient: Patients may cancel appointments with a minimum of 5-7 days' notice. Cancellations made within 48 hours of the scheduled appointment may result in forfeiture of the booking fee or advance payment.
  • 9.3 Rescheduling: If a patient needs to reschedule, notification must be provided at least 5 days in advance. The clinic will attempt to accommodate rescheduling requests based on availability. Rescheduling beyond 30 days may be treated as a new booking.
  • 9.4 Clinic Cancellation: The clinic may cancel or postpone appointments due to medical reasons, staffing issues, or emergency circumstances. Patients will be notified as soon as possible, and alternative appointment dates will be offered.

10. LEGAL AND REGULATORY COMPLIANCE

  • 10.1 Bangladesh Law: These Terms and Conditions are governed by the laws of Bangladesh. All treatments are provided in accordance with:
  • Bangladesh Medical and Dental Council (BMDC) guidelines
  • Bangladesh National Health Policy
  • International standards for assisted reproduction (ESHRE, ASRM)
  • Thailand medical regulations for parent organization guidance
  • 10.2 Age Limitation: Fertility treatments are not provided to patients above 55 years of age for female patients, except in exceptional medical circumstances reviewed by the clinical team.
  • 10.3 Marital Requirement: In compliance with Bangladesh law, fertility treatments are restricted to legally married couples. Patients must provide valid marriage certificates or government-recognized marriage documents.

11. LIMITATIONS OF LIABILITY

  • 11.1 Medical Liability: Superior A.R.T. Bangladesh and its medical staff are not liable for:
  • Natural complications arising from standard medical procedures, provided they were performed according to accepted medical standards
  • Unsuccessful treatment outcomes, including failure to achieve pregnancy
  • Patient non-compliance with medical instructions
  • Adverse reactions to medications not previously documented in patient's medical history
  • Congenital abnormalities or genetic disorders not detected by PGT testing
  • 11.2 Website Liability: Superior A.R.T. Bangladesh is not responsible for:
  • Website downtime or technical errors
  • Data loss due to cybersecurity breaches (though we employ industry-standard protections)
  • Unauthorized access to patient accounts due to patient negligence

12. DISPUTE RESOLUTION AND COMPLAINTS

  • 12.1 Complaint Procedures: Patients with complaints or grievances must submit them in writing to the clinic management within 14 days of the incident. The clinic will investigate and respond within 21 business days.
  • 12.2 Escalation: If the patient is unsatisfied with the clinic's response, the complaint may be escalated to the Bangladesh Medical and Dental Council (BMDC) or relevant medical regulatory authorities.
  • 12.3 Mediation and Arbitration: Any disputes that cannot be resolved through informal means will be subject to mediation. If mediation fails, disputes shall be subject to arbitration under Bangladesh Arbitration Act, 2001, with arbitration proceedings to be held in Dhaka.

13. AMENDMENTS AND MODIFICATIONS

Superior A.R.T. Bangladesh reserves the right to amend these Terms and Conditions at any time. Changes will be effective upon posting on the Website. Continued use of our services following notification of changes constitutes acceptance of the modified terms. Patients will be notified of substantial changes via email or direct communication.

14. SEVERABILITY

 If any provision of these Terms and Conditions is found to be invalid or unenforceable under Bangladesh law, such provision shall be modified to the minimum extent necessary to make it valid, or if such modification is not possible, the provision shall be severed. All other provisions shall remain in full force and effect.
